Welcome to DevFlake. These Terms of Use ("Terms") govern your access to and use of the DevFlake website, AI-powered products, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
By accessing and using the DevFlake website and AI-powered services, you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Services.
DevFlake provides AI-powered software development services including AI-augmented web applications, intelligent mobile apps, RAG pipelines, AI API development, SaaS products with AI cores, AI-augmented DevOps, and AI/UX design. The specific scope, timeline, and deliverables are defined in individual project agreements.
Our services utilize artificial intelligence and machine learning technologies. AI-generated outputs are reviewed by human engineers before delivery. While we strive for accuracy, AI outputs may require iteration. Clients retain ownership of all AI models trained on their proprietary data. We do not use client data to train general-purpose models without explicit consent.
Upon full payment, clients receive full ownership of all custom code, AI models trained on their data, designs, and deliverables. DevFlake retains the right to use general methodologies, AI techniques, and knowledge gained during the project. Pre-existing AI models and tools remain the property of their respective owners.
Payment terms are specified in individual project agreements. Typically, projects require a 50% upfront deposit with the remaining 50% due upon completion. Late payments may result in project suspension. All fees are non-refundable unless otherwise stated.
We handle all client data in accordance with our Privacy Policy. AI processing of client data occurs on secure, encrypted infrastructure. We do not share client data with third parties for AI training. Data retention and deletion follow industry best practices.
DevFlake's total liability shall not exceed the total amount paid for the specific project. We are not liable for AI model predictions or outputs used in production without human review. In no event shall DevFlake be liable for indirect, incidental, or consequential damages.
Either party may terminate with 30 days written notice. Upon termination, all completed deliverables and AI models will be transferred to the client. The client is responsible for payment for all work completed up to the termination date.
These terms shall be governed by the laws of Bangladesh. Disputes shall be resolved through binding arbitration in Dhaka, Bangladesh.
We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice.
